THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.11335 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking anticipatory bail to the petitioner/Accused No.2 in Crime No.292 of 2023 of Central Crime Station, Hyderabad, registered for the offences punishable under Sections 406 and 420 of IPC.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

Respondent No.2 lodged a complaint stating that accused No.1 who is the husband of the petitioner and others entered into a partnership agreement and collected an amount of Rs.3.71 crores on the ground that they would conduct business but they did not progress in the business. 4.

As seen from the complaint, there are no specific overt acts attributed to the petitioner and the allegation appears to be one of helping accused No.1, who is the husband of the petitioner in his business.

Keeping in view that the allegation is against accused No.1 who is the husband of the petitioner and considering that the petitioner is a woman, this Court is inclined to grant the relief of anticipatory bail, subject to following conditions: i) The petitioner/Accused No.2 shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) with two sureties for a like sum each to the satisfaction of Central Crime Station, Hyderabad.

ii) The petitioner/Accused No.2 after release shall appear before the concerned Station House Officer on every Monday for a period of four (04) weeks and thereafter, as and when required, for the purpose of investigation.

iii) The petitioners/Accused No.2 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
