THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASES No.1931 & 1935 OF 2015 COMMON ORDER:

1. Since the issue involved in both the revision cases and the parties are common, these revisions are heard together and being disposed of by this common order.

2. Crl.R.C.Nos.1931 and 1935 of 2015 are filed by the petitioner-accused against the orders dated 1.9.2015 passed in Crl.M.P.Nos.2053 & 2054 of 2015 in C.C.No.206 of 2014 by the learned I Special Magistrate, Vijayawada.

3. The petitioner, who is accused in the above C.C., filed the above Crl.M.Ps. before the trial Court seeking to reopen the matter and to recall P.Ws.1 and 3 for further cross-examination. The trial Court dismissed both the Crl.M.Ps. Challenging the same, the petitioner-accused filed these revisions.

4. Heard and perused the material available on record.

5. On perusal of the material available on record, it is obvious that the petitioner has not stated any reasons or the purpose for which, she intends to further crossexamine the witnesses. Therefore, the trial Court dismissed both the applications. The orders passed by the trial Court do not warrant any interference by this Court. However, in view of the submission made by the learned Counsel for the petitioner that the petitioner is ready to pay the costs to the witnesses and ready to crossexamine the witnesses on the same day that would be fixed by the trial Court, this Court is inclined to pass the following order: i.

The trial Court is directed to reopen the matter, recall P.Ws.1 and 3 and fix a date on or before 30th September, 2015, and direct the witnesses to be present on that day.

ii.

The petitioner is directed to cross-examine P.Ws.1 and 3 on the date

that would be fixed by the trial Court, and pay Rs.3,000/- to each witness towards costs.

iii.

If the petitioner fails to cross-examine those witnesses on the date that would be fixed by the trial Court, the trial Court is at liberty to proceed in accordance with law.

6. Accordingly, the Criminal Revision Cases are disposed of. Consequently, the miscellaneous petitions pending, if any, shall stand closed. _____________________ JUSTICE RAJA ELANGO Dated: 9.9.2015 Nn
