ORDER

This petition under Section 482 Cr.P.C. is filed by the petitioners/A3 to A5 seeking to quash the proceedings in Cr.No.47 of 2016 of Yemmiganur Town Police Station, Kurnool District, registered for the offence punishable under Section 406 r/w 34, 409, 420 IPC and under Section 7(1) of Essential Commodities Act, against them.

2. It is alleged in the complaint that on 03.04.2016, at 15.30 hours, on information, the Deputy Tahsildar along with his officials conducted vehicle check and found two lorries transporting 126 bags of PDS rice illegally and after enquiry, the said bags were seized in the presence of mediators under the cover of panchanama. Based on the complaint, the aforesaid crime was registered against the accused.

3. Truth or otherwise of the allegations made in the complaint have to be established by the investigating agency during the course of investigation. Therefore, this Court is not inclined to interfere with the impugned proceedings. However, the concerned police are directed to complete the investigation without arresting the petitioners/A3 to A5 and file a final report, if any, in accordance with law. The petitioners herein are directed to appear before the investigating agency as and when required and cooperate with the investigating agency.

4. With the above direction, the Criminal Petition is disposed of. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
