CRIMINAL PETITION NO. 15864 OF 2016 O R D E R :
This Criminal Petition is filed by the petitioner/A-1 under section 438 Cr.P.C. seeking to relax the condition of directing to furnish fixed deposit of Rs.50,000/- each by two sureties imposed vide order dated 26/10/2016 passed in Crl.MP.No. 3193 of 2016 by the Metropolitan Sessions Judge-cum-I-Additional District and Sessions Judge, Visakhapatnam, while granting bail in Crime No.52 of 2016 of Narsipatnam Rural Police Station.
2. Learned counsel appearing on behalf of the petitioner/A-1 submits that the petitioner is a poor person, belongs to lower strata of the society and he cannot be in a position to furnish fixed deposit of Rs.50,000/- each by two sureties.
3. Keeping in view the averments made in the said petition and submission of the counsel for the petitioner/A-1, I hereby direct the trial court to admit the petitioner/A-1 on bail on furnishing a personal
bond for Rs.25,000/- with two sureties each for the likesum to its satisfaction. The bail shall be granted subject to the verification of address of the petitioner and the sureties as well.
4. I hereby make it clear that the petitioner/A-1 shall be present as and when called by the Station House Officer, Narsipatnam Rural Police Station, Visakhapatnam district for the purpose of investigation till the filing of charge sheet.
5. The Criminal Petition is accordingly allowed.
6. As a sequel, miscellaneous petitions if any pending in this Criminal Petition shall stand disposed of.
