THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE N. BALAYOGI WRI T PETI TI ON No. 32528 of 2016 ORDER: (per Hon'ble Sri Justice Sanjay Kumar) The petitioner is the applicant in O.A.No.3174 of 2016 on the file of the Andhra Pradesh Administrative Tribunal, Hyderabad. By the said O.A., he assailed the proceedings dated 12.02.2016 of the Deputy Inspector General of Registration and Stamps, Vizianagaram, Andhra Pradesh, initiating disciplinary proceedings against him. The petitioner also sought a consequential declaration that he was entitled to be considered for promotion to the post of Sub-Registrar Grade-II without reference to the said disciplinary proceedings. By order dated 17.08.2016, the Tribunal dismissed the O.A. Aggrieved thereby, the petitioner is before this Court.

Perusal of the order under challenge reflects that the Tribunal was of the opinion that the O.A. was premature and could not be entertained as the Departmental Promotion Committee / Selection Committee was yet to consider and decide upon the candidature of the petitioner. While so, Sri V. Ravichandran, learned counsel for the petitioner, placed before us proceedings dated 17.01.2017 issued by the Deputy Inspector General of Registration and Stamps, Visakhapatnam, holding that the petitioner stood exonerated of the charge framed against him under proceedings dated 12.02.2016 of the Deputy Inspector General of Registration and Stamps, Vizianagaram.

In the light of this development post disposal of the O.A., learned Government Pleader for Services (AP) fairly concedes that there is no bar to consider the candidature of the petitioner for promotion.

The writ petition is accordingly disposed of directing the authorities to consider the candidature of the petitioner for promotion to the post of Sub-Registrar Grade-II duly taking into account the factum of his exoneration from the charge levelled against him under the proceedings dated 12.02.2016. This exercise shall be completed expeditiously and, in any event, not later than two months from the date of receipt of a copy of this order.
