THE HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.5833 of 2016 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash proceedings initiated against the petitioner/ accused in Crime No.614 of 2014 of Chilkalguda Police Station, registered for the offences punishable under Sections 468 and 420 IPC.

Heard the learned counsel for the petitioner/accused and the learned Public Prosecutor and perused the material on record.

Admittedly, a complaint was lodged by the second respondent/de facto complainant against the petitioner/accused wherein specific allegations are made against him, constituting the offences much less the alleged offences. Since specific allegations are made against the petitioner/accused, whether he has committed the alleged offences or not is a matter to be decided during investigation by the investigating agency and the same cannot be decided at the investigation stage invoking the jurisdiction under Section 482 Cr.P.C. Hence, this Court is not inclined to interfere with the proceedings and the criminal petition is liable to be dismissed.

Accordingly, the criminal petition is dismissed. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
