THE HON'BLE DR. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.11665 OF 2014 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash the proceedings against the petitioners-A.6 and A.7 in crime No.776 of 2014 of Rajendranagar police station, Cyberabad, registered for the offence punishable under Section 420 IPC.

Heard the learned counsel for the petitioners, the learned Assistant Public Prosecutor, Sri Gopala Krishna Kalanidhi, learned counsel for respondent No.2 and perused the material on record.

Without going into merits or demerits of the case, all the counsel on record conceded that the investigation in the aforesaid crime can go on without effecting arrest of the petitioners-A.6 and A.7. The offence alleged in the crime is punishable under Section 420 IPC. Having regard to the submissions made and the facts and circumstances of the case, police shall not arrest the petitioners-A.6 and A.7 pending investigation, but can proceed with investigation and file final report/charge sheet, as the case may be. With the above direction, the Criminal Petition is disposed of.

Miscellaneous Petitions pending, if any, in the Criminal Petition shall stand closed.
