THE HON'BLE DR.JUSTI CE SHAMEEM AKTHER CI VI L REVI SI ON PETI TI ON No.4 5 3 5 of 2 0 1 8 ORDER:

This Civil Revision Petition, under Article 227 of the Constitution of India, is filed by the petitioners/ plaintiffs, challenging the docket order, dated 24.07.2018, passed in O.S.No.10 of 2012, by the VI Additional District Judge, Siddipet, whereby, the simple sale deed, dated 14.12.1966, sought to be marked as an exhibit on behalf of the respondents/ defendants, was received in evidence for collateral purpose. 2 .

Heard the learned counsel for the petitioners/ plaintiffs and perused the record. There is no representation for the respondents/ defendants.

3 .

The petitioners/ plaintiffs have disputed the marking of the simple sale deed, dated 14.12.1966, as an exhibit on behalf of the respondents/ defendants in the Original Suit. The Court below had elaborately dealt with the same and held that the subject simple sale deed can be received in evidence only for collateral purpose of proving delivery of possession of the subject property under the document. There is nothing wrong on the part of the Court below in receiving the said simple sale deed in evidence for collateral purpose. There is no infirmity in the order under challenge. The Civil Revision Petition is devoid of merit and is liable to be dismissed.

4 .

In the result, the Civil Revision Petition is dismissed.

‐2‐ There shall be no order as to costs.

Pending Miscellaneous Petitions, if any, shall stand closed. ______________________ Dr . SHAMEEM AKTHER, J 15th December, 2018 Bvv
