This Criminal Petition is filed under Section 482 of the Code of Criminal Procedure, 1973 (for short 'Cr.P.C.') by the petitioner-de facto complainant to set aside the order dated 08.09.2022 passed in Crl.M.P.No.97 of 2021 in S.C.No.436 of 2016 by the Spl.Judge for trial of offences under SCs & STs (POA) Act - cum - VI Additional Metropolitan Sessions Judge, Secunderabad.

Heard learned counsel for the petitioner - de facto complainant and learned Additional Public Prosecutor for the respondent - State. Perused the material on record.

The present criminal petition is filed questioning the order of the learned Sessions Judge in refusing to receive the documents which are twenty in number filed by the State, to prove the case of the prosecution against the accused persons.

The reason given by the Additional Public Prosecutor is that the documents are necessary to establish the motive in the above case. Admittedly there are eye witnesses to the said incident and the injured
Crl.Petition No.9297 of 2022 also is a witness in the said case. For the reason of there being eye witness account, there is no necessity to prove motive in the said case. 5.
