THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.9594 of 2013 ORDER:

No representation for petitioner on 13-06-2017 and the matter was passed over for the day and taken up today. Even today, there is no representation or any accommodation is sought for. The petitioner complains inaction against respondents in considering and disposing of representation dated 22-09-2012. The Assistant Government Pleader by referring to the stand taken in the counter affidavit submits that the subject land is Government land and the direction prayed for in the writ petition is completely inconsistent and contradictory.

I have perused the prayer and also the stand taken in the counter affidavit.

This Court is of the view that the prayer as made actually amounts to controlling the discretion of the authorities from discharging their functions under an enactment. The writ petition fails and is accordingly dismissed. No order as to costs.
