HON'BLE SRI JUSTICE S.V.BHATT W.P. No.3999 OF 2013 ORDER:

Heard counsel appearing for the petitioner and the respondent.

The petitioner prays for the following relief: "..to issue an appropriate writ of mandamus declaring, illegal action of respondent in interfering in the construction of the house as per plan approved in the house bearing No.1/5/16 admeasuring 400 square yards in Survey No.35.

at Himayathasagar Village, Rajendranagar Mandal, Ranga Reddy District without due process of law is illegal arbitrary and violation of principles of natural Justice, Grampanchayat rules and regulations and Articles 14 land 21 of Indian Constitution and consequently direct the respondent not to interfere in the construction of the house as per approved plan in 400 square yards house bearing No.1/5/16 in Sy.No.35 of Himayathsagar Village Rajendranagar Mandal, Ranga Reddy District.."

On 11.02.2013, this Court passed the detailed interim order. The respondent neither filed counter affidavit nor sent instructions on the grievance of the petitioner. Counsel for petitioner requests the Court to dispose of the writ petition by making the interim order as final order. He further states that if at all the respondent wants to interfere with possession or construction made by the petitioner at the subject site, the same shall be in accordance with law.

While making the interim order as final order in the writ petition, it is made clear that if the respondent notices any

deviation or any encroachment by petitioner, necessary action can be taken in accordance with law.

The writ petition is disposed of accordingly. No order as to costs.
