THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.15933 OF 2017 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:- "to issue a writ, order or direction more particularly one in the nature of writ of Mandamus declaring the action of the respondent in trying to dispossess the petitioner from house bearing Plot No.397, Mahatmagandhi EWS Colony, presently called as Sai Prashanth Nagar, situated at HUDA Layout No.9427/MP2/HUDA/88, Proc.No.D/5838/84 & Patta No.B/3202/92, dt:29.06.1989 (revised) at Sy.No.57, Shamshiguda, Kukatpally Mandal, Medchal District though the regulation application is pending before 2nd respondent following without due process as illegal, arbitrary and violative of Article 14, 21 and 300 (A) of Constitution of India and consequently direct the respondents not to dispossess the petitioner from the petition scheduled plot No.397 and pass such other or further orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

The main grievance of the petitioner is that on the ground that he purchased an assigned land from one Nafin Sulthana in whose name the patta certificate was issued by the revenue authorities in the year 1992, respondent Nos.2 and 4 herein are trying to dispossess him from the said plot without following the due process of law.

Heard and perused the material available before this Court.

Considering the facts and circumstances of the case and the grievance of the petitioner, without going into the merits of the case, the official respondents are hereby directed not to dispossess the petitioner from the aforesaid house plot without following the due process of law.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
