HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 6600 of 2016 O R D E R:- Heard learned Counsel for the petitioner and learned Government Pleader for Civil Supplies appearing for the respondents.

The case of the petitioner is that she was appointed as Dealer of Fair Price Shop No.101 of Maruthinagar, Karimnagar Mandal and District. While so, on 13.02.2016 the Deputy Tahsildar (CS), Bheemdevarapally, along with the Food Inspector, Karimnagar, inspected the shop and found certain irregularities and submitted a report. Based on the said report, the 2nd respondent issued a show cause notice to the petitioner on 20.02.2016 calling upon her to explain the reasons as to why her authorization should not be cancelled, within seven days from the date of receipt of the notice, for which she submitted explanation on 23.02.2016. But however, on the date of issuance of the show cause notice itself, the 2nd respondent cancelled her authorization. Challenging the same, she filed the present writ petition.

A perusal of the record shows that on 20.02.2016, the 2nd respondent issued a show cause notice to the petitioner and cancelled the authorization of her Fair Price Shop on

the even date on the allegations that there are certain variations in the stocks and the petitioner indulged in clandestine business. In view of the same and inasmuch as the petitioner already submitted her explanation to the show cause notice, interest of justice would be served, if the 2nd respondent is directed to conduct an enquiry against the petitioner by taking into consideration the explanation submitted by her.

Accordingly, the 2nd respondent is directed to complete the enquiry by taking into consideration the explanation submitted by the petitioner and pass final orders within a period of four weeks from the date of receipt of a copy of this order, by duly observing the principles of natural justice and affording an opportunity of being heard to the petitioner.

Subject to the above, the Writ Petition is disposed of at the admission stage. Consequently, miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed. No order as to costs.
