The petitioner is working as an Assistant Director, Mines and Geology Department, Karimnagar. While he was working at Chittoor before the State of Andhra Pradesh was divided, two disciplinary proceedings were initiated against him. As his promotion was withheld due to the pendency of the disciplinary proceedings, the petitioner filed OA.No.1367 of 2016 before the Andhra Pradesh Administrative Tribunal, Hyderabad (for short 'the Tribunal'). The Tribunal has issued notice to the respondents returnable in six weeks and further observed that the future promotions, if any, to the post of the Deputy Director shall be subject to final result in the OA. Feeling aggrieved by this Order, the petitioner filed this Writ Petition.

Since the petitioner's promotion is withheld on account of pendency of the disciplinary proceedings, this Court has adjourned the case on 21-04-2016 to enable the learned Government Pleader to find out the reasons for non-completion of the disciplinary proceedings initiated in the years

2012 and 2014.

Today, Mr.B.Mahender Reddy, learned Special Government Pleader representing the State of Telangana, submitted that as the disciplinary proceedings were initiated by the erstwhile State of Andhra Pradesh, the said proceedings are pending before respondent No.2 i.e., residuary State of Andhra Pradesh and that the petitioner has been allocated to the State of Telangana, in which he is presently working.

Inasmuch as the petitioner has become the employee of respondent No.1, he shall be subjected to the disciplinary proceedings of the said respondent. Therefore, it is appropriate that respondent No.1 concludes the disciplinary proceedings within a reasonable time schedule. The learned Special Government Pleader submitted that the entire files relating to the disciplinary cases against the petitioner are with respondent No.2. Therefore, respondent No.2 is directed to forthwith transmit the files to respondent No.1.

Respondent No.1 shall conclude the disciplinary proceedings within four months from

the date of receipt of this order and pass appropriate orders thereon.

Subject to the above directions, the Writ Petition is disposed of.
