HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.10966 OF 2016 ORDER:
The grievance of the petitioner is that on 02.03.2016, its vehicle bearing registration No. AP 21 TU 3748 was seized on the allegation that he was transporting PDS rice. The petitioner submits that the travel documents, as required under the relevant Regulations, were in fact being carried by the petitioner. In that view of the matter, the petitioner seeks release of the said vehicle.
Learned counsel for the petitioner submits that necessary documents accompanying the vehicle were shown to the authorities at the time of check. However, there is no mention about the said documents in the panchanama. In the interests of justice, pending 6A proceedings, the seized vehicle of the petitioner shall be released on condition of petitioner furnishing third party security equivalent to the value of the vehicle, as assessed by the 2nd respondent, and on a further condition of petitioner furnishing an undertaking that it will not alienate the vehicle or create any third party interest over it and will not alter its nature, pending disposal of the proceedings before the 2nd respondent.
With the above direction, the writ petition is disposed of. No order as to costs.
Miscellaneous petitions, if any pending in the writ petition, shall stand be closed.
