THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.1850 of 2008 ORDER:

This Writ Petition is filed seeking the following relief/s:- "To issue a Writ, order or direction more particularly one in the nature of writ of Mandamus declaring the inaction of the respondents 1 and 4 in convening the meeting of the Gram Panchayat for formation of the Habitation Works Committee in terms of G.O.Ms.No.37 Panchayat Raj & Rural Development (PROGS.IA) department dated 18.02.2005 and the inaction of the 3rd respondent in entrusting the work "Construction of Main of MPWS at Sanjeev Nagar of Kavali Yadavalli Village" to the petitioner Gram Panchayat as illegal arbitrary unjust discriminatory and violative of Article 14 of the Constitution of India and the judgment of the Hon'ble Court in W.P.No.9215 of 2007 and Batch dated 27.07.

2007 and consequently direct the respondents 2 to 4 to form the Habitation Works Committee and direct the 3rd respondent to entrust the above said work to the petitioner Gram Panchayat in terms of G.O.Ms.No.37 Panchayat Raj & Rural Development (PROGS.IA) department dated 18.02.

[Reproduced verbatim] The learned counsel for the writ petitioner would submit that a batch of writ petitions seeking similar relief were already allowed by this Court and that considering the said orders, an interim order was passed on 01.02.2008 as follows: "In respect of the works to be allotted, the respondents 2 to 4 are directed to form the Habitation Works Committee in terms of G.O.Ms.No.37 Panchayat Raj & Rural Development (PROGS.IA) department dated 18.02.2005"

He would also submit that in view of the above said interim order, nothing survives for adjudication in this writ petition and that therefore, the writ petition may be disposed of.

The learned Standing Counsel for the Zilla Parishads (AP) and the learned Government Pleader for Panchayat Raj (AP) endorse the said submission of the learned counsel for the writ petitioner.

Recording the said submission of the learned counsel for the writ petitioner, the Writ Petition is disposed of as no cause survives for adjudication. No costs. Miscellaneous petitions pending, if any, in this writ petition shall stand closed.
