HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.28982 OF 2016 ORDER:
The case of the petitioners is that they are the absolute owners and possessors of the property bearing in survey No.42/20, admeasuring Ac.4.20 guntas, situated at Naspur Village, Mancherial Mandal, Adilabad District, having acquired the same by way of registered will vide document No.24/2015, dated 10.09.2015 and have been in peaceful possession and enjoyment of the said land. While so, for the purpose of development of the said lands the petitioners approached bank for getting financial aid and the bank authorities insisted the petitioners for production of computerized pahanis along with revenue records to ascertain petitioners' ownership and possession over the subject lands. As such, the petitioners submitted a representation on 29.09.2015 before the 4th respondent for incorporating their names in computer pahanis, but till today no action has been taken on the said representation. Aggrieved by the same, present writ petition is filed.
Heard both sides.
Since the application of the petitioners dated 29.09.2015 is pending before the 4th respondent, without going into the merits of the case, the 4th respondent is directed to consider the application of the petitioners basing on the registered will vide document No.24/2015, dated 10.09.2015 and dispose of the same in accordance with law after issuing notice to the affected parties if any, within a period of eight weeks from the date of receipt of a copy of this order.
Accordingly, the writ petition is disposed of. No order as to costs.
