THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.27691 of 2018 ORDER:

The petitioners challenge the proceedings dated 22.05.2017 regularizing the alleged agreement of sale in favour of respondents 4 to 8.

The Assistant Government Pleader objects to the maintainability of writ petition. According to him, the petitioners are required to file appeal with an application to condone the delay in filing appeal but filing of writ petition is untenable.

Mr.Srinivas seeks liberty to file appeal before the 2nd respondent.

In view of the above, the writ petition is disposed of by this order:

(a) The petitioners are given liberty to file appeal along with an application to condone the delay within two (02) weeks from today.

(b) The 2nd respondent considers the appeal as well as interlocutory applications expeditiously and passes orders, as are fit and proper in the circumstances of the case.

(c) The parties are directed to maintain status quo as regards entries for agricultural land in an extent Ac.0-60 cents out of Ac.3-45 cents in Sy.No.22-2B for a period of four

(04) weeks from today.

(d) The petitioners can seek appropriate reliefs before the 2nd respondent before four (04) weeks period expires. No order as to costs.

Miscellaneous petitions, if any, pending, shall stand closed.
