THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CIVIL REVISION PETITION No.420 of 2014 ORDER:

The civil revision petition is filed under Section 115 of Code of Civil Procedure (for short "C.P.C.") challenging the order dated 20.01.2014 passed in E.P.No.137 of 2010 in O.S.No.780 of 1998 by the I Additional Junior Civil Judge at Kovvur, whereby decree holder is permitted to proceed further in Execution Petition by issuing notice under Order XXI Rule 37 of C.P.C. against the judgment debtor.

During hearing, Mrs.Anula representing Mangena Sreerama Rao, learned counsel for the petitioner submitted that the Judgment Debtor is ready to pay the balance amount after deducting amount deposited in pursuance of the interim direction issued by this Court on 29.04.2014, within a month from today. Recording the said submission, one month time is granted to the petitioner/judgment debtor for payment/deposit balance of decreetal amount together with interest and costs. With the above direction, the civil revision petition is disposed of. However, in the event of failure to deposit balance amount within one month from today, the order of this Court shall stand cancelled automatically and the respondent is permitted to proceed further in accordance with law to realise the decreetal amount without approaching this Court and the Executing Court is directed to proceed with the matter in accordance with law. No costs.

MSM,J CRP.No_420_ 2014 The miscellaneous petitions pending in all the three revisions, if any, shall also stand closed.
