It is the case of the petitioner that though a case was registered against him in FIR No.39/ACB-KNR/2014, dated 04.12.2014 under Sections 7 and 13 (1) (d) read with Section 13 (2) of Prevention of Corruption Act, 1988 but as on today no charge sheet is filed nor charge memo or disciplinary proceedings has been issued against him but he is not considered for promotion basing on the registration of crime, which is illegal and his case has to be considered for promotion in terms of orders issued in G.O.

Ms.No.66, General Administration (Services.C) Department dated 30.01.1991.

In support of his contention, he relied on the order passed by this Court on 17.04.2017 in W.P. No.2449 of 2017.

Heard both sides.

In view of the facts and circumstances of the case, if no charge sheet is filed in criminal case and no charge memo has been issued against the petitioner, respondents are directed to consider the case of the petitioner for promotion to the post of Assistant Registrar of Cooperative Societies without reference to the registration of above crime in accordance with rules.

With the above direction, the writ petition is disposed of. However, this order will not preclude the authorities from proceeding with the disciplinary proceedings. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 30-08-2017 knl
