HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.3887 of 2015 ORDER :

This Criminal Petition is filed by the Petitioner/ accused No.7 under Section 482 Cr.P.C seeking to quash the proceedings in Crime No.604 of 2014 of L.B Nagar Police Station, Cyberabad registered for the offence punishable under Section 420 IPC.

2) Heard learned counsel for the petitioner/ accused No.7 as well as 1st respondent-State representing through learned public prosecutor before admission and before ordering any notice to respondent Nos.2 to 4/ de facto complainants. Perused the material on record.

3) A perusal of the report no way requires interference to admit the application filed under Section 482 Cr.P.C but for the facts otherwise permit the petitioner as a NRI, undisputedly, though claimed as person of the firm that collected the chit amount and claimed to transfer the property of the firm in his name, to admit entitlement of anticipatory bail to the petitioner, thereby under Section 482 Cr.P.C read with Section 438 Cr.P.C, the Criminal Petition is disposed of granting anticipatory bail to the petitioner/ accused No.7 to surrender within twenty (20) days from today before the learned Magistrate concerned and execute a personal bond for Rs.

1,00,000/- (Rupees one lakh only) with two sureties to the satisfaction of the learned Magistrate and undertake to appear till filing of final report, for any accused persons as part of investigation. In the mean time, not to insist his appearance before the Court for adjournments pending investigation. Meantime enabling the petitioner to attend before the Court, if he failed to attend and comply with the order on or before 24.06.2015, this order seizes its force without any further right of extention of time.

4) Accordingly, the Criminal Petition is disposed of.

5) As a sequel, miscellaneous petitions, if any filed in this Criminal Petition, shall stand closed.
