THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.25616 of 2016 ORDER:

The petitioners are working as Field Assistants under the Mahatma Gandhi National Rural Employment Guarantee Scheme. They were appointed in the year 2008 in the Villages of Neelipudi, Nidamarru and Kommalapudi of Kruthivennu Mandal of Krishna District. The period of contract expired by 30.06.2015 and when the same was not extended by passing the impugned orders dated 20.08.2015, the present Writ Petition is filed.

Learned Counsel for the respondents, on the basis of the written instructions, submits that the petitioners failed to achieve the required target of minimum person days of 5000 and 75% approved labour budget for the year 2014-2015. In view of the same, basing on the circular issued by the Commissioner, dated 11.08.2015, the contract of the petitioners was not renewed. However, when the similarly situated persons approached this Court by filing W.P.No.27468 of 2015, this Court directed consideration of the cases by a Committee, and accordingly, a three men committee was constituted in respect of Kruthivennu Mandal. When a notice was issued asking the petitioners to attend before the Committee with explanation on 10.03.2016, the petitioners did not attend before the Committee and did not submit any explanation. In view of the same, the earlier non-renewal of the contract was not reviewed.

In spite of giving an opportunity by the three men committee, the petitioners did not attend before the Committee appointed pursuant to the orders of this Court. This Court gave an opportunity for review of the cases where the contracts were not renewed. Since the petitioners did not avail the same, this Court cannot grant any relief to the petitioners. The petitioners also did not file any evidence having appeared before the Committee.

The Writ Petition is, accordingly, dismissed. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
