THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.28666 OF 2015 ORDER:

Heard learned counsel for the petitioner, learned Government Pleader for Revenue appearing for respondents 1 to 4, learned Government Pleader for Roads and Buildings appearing for respondent No.5 and Sri T. Sudhakar Reddy, learned Standing Counsel appearing for respondent No.6.

The case of the petitioner is that the land admeasuring 76 sq. yards in Survey No.44 of Shamirpet Village, Ranga Reddy District, was acquired for the purpose of Four Lane road from Hyderabad to Karimnagar to an extent of K.M. 28/2 to 235/58. The petitioner states that for the land admeasuring 41 sq. yards, compensation was paid. The grievance of the petitioner is that the land admeasuring 76 sq. yards was also taken possession, but no compensation was paid and pointing out the deficiency in the award, the petitioner has made representations, but no action was taken. It appears that pursuant to the representations of the petitioner, the Tahsildar, Shamirpet Mandal, sent a report to the Special Grade Deputy Collector and Revenue Divisional Officer, Malkajgiri Division, Ranga Reddy District, the 3rd respondent, in file No.

B/2785/2014, dated 15.01.2015, stating that after receiving the report of the surveyor, the land of the petitioner admeasuring 76 sq. yards in Survey No.44 was acquired under Rajiv Rahadari Road and location sketch prepared by the Mandal Surveyor was also attached. It is stated that though the petitioner made representations to the 3r d respondent, the latest being dated 31.08.2015, seeking compensation with regard to land admeasuring 76 sq. yards is pending and no award is passed.

Hence, it would be just and appropriate to direct the 3rd respondent to consider the petitioner's aforesaid representation in the light of the report of the Tahsildar and other connected records and take appropriate decision in the matter as expeditiously as possible, preferably within a period of four weeks from the date of receipt of a copy of this order.

With the above observation, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
