THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.11393 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.1 in Crime.No.1144 of 2023 on the file of Hayathnagar Police Station, Rachakonda Commissionarate, Ranga Reddy District, registered for the offences under Sections 498-A and 304-B of IPC. 2.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The case of the de-facto complainant is that the deceased is his sister who was given in marriage to this petitioner. The marriage was performed on 20.11.2019 and at the time of marriage, demands of this petitioner and others were also met. However, the deceased was subjected to mental and physical harassment and also abused her in filthy language. 4.

On 04.10.2023, the de-facto complainant received a message that his sister died. It is alleged that this petitioner and others who are family members have harassed the deceased and

unable to bear the harassment for additional dowry, the deceased committed suicide.

The other accused/A-2, A-3 and A-5 were arrested and relief of regular bail was granted and A-4 was granted anticipatory bail.

As seen from the remand report, most of the witnesses were examined.

Since the petitioner is in jail from 19.10.2023, the relief of regular bail can be considered, subject to following conditions:- i) The petitioner/Accused No.1 shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty Five thousand only) with two sureties, for a like sum each to the satisfaction of the XIV Additional Metropolitan Magistrate at Hayathnagar.

ii) The petitioner/Accused No.1 after release shall appear before the concerned Station House Officer at 10:00 a.m. on every Monday for a period of eight weeks for the purpose of investigation and thereafter, as and when required.

(iii) The petitioner/Accused No.1 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
