Heard Mr.M.V.Rama Rao for petitioner.

The learned counsel for the petitioner requests time to enable the petitioner to engage another Advocate.

On 06.07.2010, this Court directed respondents to consider the case of petitioner for appointment by transfer as Sub-Engineer by treating the petitioner as Diploma holder during the pendency of the writ petition.

The respondents filed WVMP No.188 of 2016 to vacate the said order. In the counter affidavit, it is stated that the respondents, in fact, have considered the case of petitioner as directed by this Court on 06.07.2010 and have issued memo No.

CGM(A)/DS(A)/AS (Panels)Techl.)/PO-C/2523/2010 dated 23.11.2011 rejecting his prayer for consideration. In the considered view of this Court, with the issuance of memo dated 23.11.2011, circumstances are changed and the petitioner has to work out remedy if any against the communicated dated 23.11.2011. Having regard to the above circumstances, the request for adjournment is refused. The writ petition is dismissed as infructuous with liberty to assail proceedings dated 23.11.2011. No order as to costs.
