THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.11395 OF 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioner/Accused No.1 seeking bail in the event of his arrest in connection with Crime No.16 of 2023 on the file of Women Police Station, Warangal, registered for the offences under Sections 498-A, 307, 494 and 506 of IPC.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The de-facto complainant who is the wife of this petitioner filed a complaint on 30.08.2023 alleging that this petitioner and four others harassed her physically and mentally. Further, this petitioner had re-married during the subsistence of marriage with the de-facto complainant. The allegation is that for reason of this petitioner having relationship with someone else, this petitioner and others were questioned, all the accused tried to strangulate her
with her chunni cloth. However, when she shouted for help, accused went away.

Admittedly, there are no injuries that were received in the alleged incident. There are differences between the spouses resulting in the complaint.

On instructions, learned Additional Public Prosecutor submit that investigation is complete, charge sheet is already filed, however, warrants are pending against the petitioner.

Keeping in view that the complaint is outcome of differences between the spouses and investigation is already complete, this Court deems it appropriate to direct the petitioner to appear before the concerned Court where PRC proceedings are pending on or before 08.12.2023. Upon such surrender, the warrants issued against the petitioner shall be recalled on executing personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties, for a like sum each to his satisfaction. Needless, to say, the petitioner shall not leave the country without prior permission of the concerned Court. Any other conditions, the learned Magistrate may impose in the interest of trial.

Accordingly, the Criminal Petition is disposed off. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
