HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.771 of 2017 ORDER:

This writ petition is filed by the petitioner under Article 226 of the Constitution of India seeking to direct the respondents to release the assured amount of the policy bearing No.050202/42/10/05/00000412. 2.

It is the case of the petitioner that she is the wife of Thanduri Madhu, and her husband died on 6.1.2012 while he was working as Collection Manager in Kapil Chit Funds Private Limited and during his life time, the employer of her husband made two personal accidental policies with the 2nd respondent and after his death, the petitioner made a claim for the amount of Policy No.050202/42/11/05, 00000242, for which she was a nominee and she received insured amount from the 2nd respondent. In respect of the policy in question, the father-in-law of the petitioner was the nominee and he also died on 3.2.2016 and during his life time, he did not make any claim for the said policy. When the petitioner approached the 2nd respondent claiming the amount of the policy in question, the 2nd respondent is insisting for production of succession certificate. In spite of her representation, the respondents are insisting for production of succession certification.

Heard and perused the material available on record. 4.

Considering the facts and circumstances of the case, without expressing any opinion on merits, this Court is inclined to pass the following order:

"The respondents are directed to consider the representation of the petitioner and pass appropriate orders."
