THE HON'BLE THE CHIEF JUSTICE SATISH CHANDRA SHARMA AND THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT APPEAL No.675 of 2021 JUDGMENT: (Per the Hon'ble the Chief Justice Satish Chandra Sharma) The present writ appeal is arising out of an order dated 23.12.2021 passed by the learned Single Judge in W.P.No.28851 of 2013, vacating the interim order granted in the matter.
The facts of the case reveal that the writ petition was preferred by the appellant herein (writ petitioner) being aggrieved by the notice dated 27.09.2013 issued by the Greater Hyderabad Municipal Corporation under Section 456 of the Hyderabad Municipal Corporation Act, 1955, and the learned Single Judge has granted an interim order of status quo. Subsequently, the said interim order has been vacated, challenging which the present writ appeal has been filed.
During the pendency of this writ appeal, a report has been obtained from the Indian Institute of Technology (IIT) Hyderabad and the same is on record.
In the light of the aforesaid, the learned Single Judge is requested to decide the writ petition itself finally. The learned Single Judge shall also be free to take into account the report submitted by the IIT Hyderabad.
Office is directed to list W.P.No.28851 of 2013 before the learned Single Judge having roster on 27.04.2022 on which date the parties shall appear before the learned Single Judge. Office is also directed to forward a copy of the report submitted by the IIT Hyderabad along with the record to the learned Single Judge enabling the learned Single Judge to pass appropriate orders.
The interim order granted in the writ appeal shall continue till tomorrow i.e., 27.04.2022.
The writ appeal is accordingly disposed of.
