HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 39569 of 2016 ORDER:
1) Heard learned counsel for the petitioners and Government Pleader for Revenue. With the consent of both the parties, the writ petition is being taken up for hearing at the admission stage itself.
2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the third respondent in not passing any orders on the application dated 11.06.2016 made by the petitioners under Section 5-A of the Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971 (for short " the Act" ); and consequently direct the third respondent to dispose of the representation.
3) The grievance of the petitioners is that though they made representation on 11.06.2016 till date no orders are passed by the respondent-authorities and hence seeks a direction to the respondents to dispose of the representation at an early date. 4) Government Pleader for Revenue submits that the reason for not considering the representation was in view of pendency of W.P.No.9957 of 2010 and since the said writ petition is now disposed of on 14.11.2016, a direction may be given to consider the representation.
5) In view of the submissions made, the writ petition is disposed of directing the respondent-authorities to pass orders on
the representation dated 11.06.2016, if any made by the petitioners, in accordance with law, as early as possible. There shall be no order as to costs.
6) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
