Order:

This Writ Petition is filed for a Mandamus to set aside the notice in proceeding No.DSP/785( )/2012-SRCL, dated 12.01.2012, of respondent No.2, whereby he has directed the petitioner to produce the bank guarantee for a sum of Rs.5 lakhs claimed by the dependants of the person, who died in the motor accident involving the petitioner's hire bus, till disposal of OP.No.417 of 2011 filed by them.

At the hearing, the learned Counsel for both the parties submitted that OP.No.417 of 2011 itself was disposed of on 22.08.2014, wherein compensation was awarded against the petitioner and the Insurance Company with joint and several liability, and that therefore, the cause in this Writ Petition does not survive for adjudication.

In the light of the above facts and circumstances of the case, the Writ Petition is dismissed as infructuous.

As a sequel to dismissal of the Writ Petition, interim order, dated 03-02-2012, is vacated and WVMP.No.2181 of 2012 and WPMP.No.3403 of 2012 are disposed of as infructuous.
