Vasam Tulashamma [Surrendered Naxalite] v. The District Collector,
THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.5618 of 2012 O R D E R :
Heard counsel for the petitioner and the Government Pleader for Revenue appearing for respondents.
2. It is the case of the petitioner that she is a surrendered extremist, who had been granted house site patta and agricultural land by the State Government and that the then Tahsildar, Nalgonda Mandal on 10.04.2011 trespassed into her house, abused her and took away original documents pertaining to the land and house premises. She claims to have filed a complaint on 13.02.2012 to the 1st respondent against the then Tahsildar.
3.
Counter affidavit is filed by the 2nd respondent, the present Tahsildar of Nalgonda Mandal, stating that the Tahsildar, against whom the petitioner has leveled the above allegations, retired from service after attaining superannuation on 29.02.2012. Once the said Tahsildar, Nalgonda Mandal has retired from service, no disciplinary action can be initiated against him by the 1st respondent.
4. Since counsel for the petitioner states that the petitioner is pursuing criminal proceedings against the said person, I am of the opinion that no relief can be granted to the petitioner in this Writ Petition.
5. Accordingly, this Writ Petition is dismissed. There shall be no order as to costs.
6. Consequently, miscellaneous petitions pending if any, shall stand closed.
