This petition is filed, by the petitioners, who are the accused, seeking for quash of the proceedings in Crime No.601 of 2010 of Vijayawada I Town Police Station. The offences alleged are under Sections 498A and 420 IPC.

Heard the counsel for the petitioners and the Public Prosecutor appearing for the 1st respondent. None appears for the 2nd respondent in spite of notice.

The counsel for the petitioners submits that no specific allegations are made against the petitioners. But, a perusal of the complaint would show that though the allegations are omni bus in nature, there are specific instances of harassment alleged against the petitioners. It was also alleged that apart from harassing the 2nd respondent, her gold ornaments were also forcibly taken and mortgaged.

In the above circumstances, this court opines that this is a case where the trial has to be conducted to get the truth of the matter and hence, it is not safe to quash the proceedings against the petitioners.

With the above observations, the Criminal Petition is dismissed.

Interim stay granted by this court, dated 19.01.2011, shall stand vacated.

As a sequel, the miscellaneous applications, if any pending, shall stand closed.
