THE HON'BLE SRI JUSTICE A.ABHISHEK REDDY WRIT PETITION No.7505 of 2005 ORDER:
This writ petition is filed seeking the following relief: " ... declaring the action of the respondents in not considering the petitioner's application for recalling GO Ms No.646 Revenue Department dated 01.10.2001 and for continuing GO Ms No.1127 Revenue Department dated 12-11-1993 enabling the petitioner society to continue the lease rights in respect of land admeasuring Ac.8.36 gts in Sy No.45 & 60 situated at Madannapet Village, Saidabad Mandal, Hyderabad District, as being illegal, arbitrary, unconstitutional and consequently direct the respondents to forthwith recall GO Ms No.646 dated 1-10-2001 and continue the lease granted to the petitioner society in respect of the said property in terms of GO Ms No.1127 dated 12-11-1993 and ......"
2. Heard the learned counsel for the petitioner as well as the learned Government Pleader. Perused the record.
3. On 17.10.2019, this Court directed the learned Government Pleader to get latest instructions in respect of the representation made by the writ petitioner on 05.11.2004.
4. Today, the learned Government Pleader has submitted latest written instructions, which reveal that the subject matter of the land has been allotted to various government departments vide various proceedings of the District Collector, Hyderabad. Learned Government Pleader further submits that the said allottees were put in possession, they have constructed buildings in the land allotted to them and using it for the purpose for which it was allotted.
5. In view of the submissions of the learned Government Pleader and the averments of the written instructions, learned counsel for the petitioner seeks leave of the Court to challenge the various allotments made by the District Collector, Hyderabad, through various proceedings.
Therefore, the writ petition is dismissed granting leave to the writ petitioner as sought for.
As a sequel, miscellaneous petitions pending in this writ petition, if any, shall stand closed. No orders as to costs. ________________________ A.ABHISHEK REDDY, J 24.10.2019.
