HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.37100 OF 2016 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is preferred by the petitioner seeking to declare the action of the 1st respondent in proposing to issue pattadar pass books and title deeds along with I-B record in respect of land in survey No.124 to an extent of Acs.3-01 cents and in survey No.118-1 to an extent of Acs.1-79 cents situated at Kamarupalli Village, Ananthapuramu Rural Mandal and District, as illegal and arbitrary.

Heard the learned counsel for the petitioner as well as the learned Assistant Government Pleader for Revenue (AP) for respondents 1 and 4. With their consent, the writ petition is disposed of at the stage of admission itself. There is no necessity to put respondents 2 and 3 on notice since this Court is not venturing to adjudicate the case on merits.

Though various grounds are raised, the learned counsel for the petitioner mainly submits that taking advantage of mistake in mentioning the extents of land, the unofficial respondents applied for issuance of pattadar pass books and title deeds and if the same are issued grave injustice will be caused to the petitioner. He further submits that before issuance of any such pattadar pass books and title deeds, objections of the petitioner may be directed to be considered by the concerned authorities.

Learned AGP would submit that the authorities would consider issuance of pattadar pass books and title deeds after considering the objections received, if any.

Having regard to the rival submissions made, the Writ Petition is disposed of directing the Tahasildar-1st respondent to consider the objections filed by the petitioner, before issuing pattadar pass books and title deeds to respondents 2 and 3, if not already issued. Petitioner shall file her objections, if any, within a period of ten days from today.
