THE HON'BLE SRI JUSTICE RAJA ELANGO Tr. Criminal Petition No.90 of 2016 ORDER:

This transfer Criminal Petition is filed under Section 482 Cr.P.C. seeking to transfer C.C.No.160 of 2015 pending on the file of XXI Metropolitan Magistrate, Cyberabad at Medchal to the Court of Judicial First Class Magistrate, Nandyal to be tried along with M.C.No.41 of 2015 pending on its file.

Heard the learned counsel for the petitioner and perused the material on record.

A perusal of the material on record and the grounds of the criminal petition reveal that the grounds raised by the petitioner for seeking transfer of the case to some other Court are not tenable and justifiable and they are made only on surmises and conjectures warranting the jurisdiction of this Court to transfer the case, and hence, the transfer criminal petition is misconceived and the same is liable to be dismissed.

Accordingly, the transfer criminal petition is dismissed. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
