HON'BLE SRI JUSTICE A.RAJASHEKER REDDY CIVIL REVISION PETITION No.6490 OF 2006 O R D E R:

This Civil Revision Petition is filed against the order dated 08.12.2006 passed by the Joint Collector-I, Ranga Reddy District in Appeal Case No.F2/3786/2005, wherein the Joint Collector remanded the matter to the Mandal Revenue Officer for fresh consideration.

Learned counsel for the petitioners submits that though the order dated 13.02.2002 in CRP.No.2334/2000, has become final and the same was referred to by the Joint Collector, while remanding the matter to the MRO the said aspect was not mentioned. As such, the learned counsel submits that the order dated 13.02.2002 in CRP.No.2334/2000 may also be considered by the Mandal Revenue Officer while deciding the matter.

Heard learned counsel for respondents 8 to 15. Since the impugned order dated 08.12.2006 passed by the Joint Collector-I is only a remand order, no rights of the parties are affected and the record goes to show that the CRP filed by the 1st petitioner is also pertains to same subject property.

In view of the same, the Mandal Revenue Officer is directed to take into account the order dated 13.02.2002 passed by this Court in CRP.No.2334/00, while passing the orders afresh in pursuance to the remand order dated 08.12.2006 passed by the Joint Collector. The MRO shall decide the issue after issuing notices to the petitioners as well as respondents within a period of three months from the date of receipt of a copy of this order. Till then, Status quo granted by this Court on 27.12.2006, shall continue.

Accordingly, the Civil Revision Petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the CRP, shall stand closed.
