B.Vykunta Vasu v. B.Krishna Kumari
HON'BLE SRI JUSTICE C.V. NAGARJUNA REDDY C.R.P.No.150 of 2015 Date : 6-2-2015 Between :
B. Vykunta Vasu and another .. Petitioners And B. Krishna Kumari and others .. Respondents Counsel for petitioners : Mr. Bankatlal Mandani Counsel for respondents : --
The Court made the following:
ORDER:
Petitioner No.1 who is the husband of respondent No.1, filed this Civil Revision Petition against order dated 1512-2014 in I.A.No.260 of 2014 in O.S.No.455 of 2006 on the file of the learned X Additional Chief Judge (Fast Track Court), Ranga Reddy District, whereby the lower Court has allowed the application filed by respondent No.1 for amendment of plaint to introduce the relief of right to residence and maintenance.
At the hearing, the main ground urged by Mr. Bankatlal Mandani, learned Counsel for petitioner No.1, who has alone signed the vakalath in this Revision Petition, is that the application filed by respondent No.1 is belated. A perusal of the order of the lower Court shows that satisfactory reasons have been assigned by it to allow the application of respondent No.1. The lower Court having exercised its discretion, which on the facts and circumstances of the case appear to be sound, I am not inclined to interfere with the said order in exercise of my supervisory jurisdiction under Article 227 of the Constitution of India.
The Civil Revision Petition is accordingly dismissed. As a sequel to the dismissal of the Civil Revision Petition, CRPMP No.178 of 2015 filed for interim relief is disposed of as infructuous.
