HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION NO. 6230 OF 2016 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India, seeking the following relief: "to issue a writ of mandamus or any other appropriate writ or direction declaring the action of the 2nd respondent in passing orders dated 18.2.2016 by confirming the orders of the 4th respondent dated 18.1.2016 wherein 4th respondent refused the request of the petitioner to issue summons to the witnesses whose names are mentioned in the representation dated 18.1.2016 who are five in number to attend the enquiry as illegal, arbitrary and consequently direct the 4th respondent to issue summons to the witness whose names are mentioned in the representation dated 18.1.2016 and pass such other or further orders as the Hon'ble Court feels deem fit and proper in the facts and circumstances of the case."

2. Heard Sri G. Sravan Kumar, learned counsel for the petitioner and Sri B. Raj Kiran, learned Standing Counsel for respondents.

3. By virtue of the impugned order, the second respondent rejected the request of the petitioner to issue summons to the witnesses indicated by the petitioner.

During the course of hearing, it is submitted by the learned Standing Counsel for respondents that it is up to the petitioner herein to produce the witnesses in support of his case.

5. On hearing the same, it is requested by the learned counsel for the petitioner to permit the petitioner to produce witnesses by granting

two weeks time.

In view of the same, the Writ Petition stands disposed of permitting the petitioner to produce witnesses within a period of two weeks from today. It is also made clear that in the event of failure to produce witnesses as requested above, it is open for the respondents to proceed in accordance with law. There shall be no order as to cots.
