This Writ Petition is filed for a Writ of Mandamus declaring the action of the respondents in conducting the public auction for the lands to an extent of Acs.7.91 cents in Survey Nos.672/1, 2, 4, 729/1, 2, 3, 4, 5, 866/1, 2, 4, 887/2, 3, 4, 888/1 and 890/1, 2, situated at Dhulipudi Village, Nagaram Mandal, Guntur District, as illegal and for a consequential direction to the respondents to continue the petitioner as lessee of the aforesaid lands. The case of the petitioner is that he is lessee of the abovementioned lands and he requested the respondent-authorities for extension of lease. Without considering the said request, the respondent-authorities are contemplating to conduct auction on 11.05.2015. Aggrieved by the same, the present Writ Petition is filed.
Learned counsel for the petitioner submitted that though the petitioner is a lessee, without following due process of law, the respondent-authorities are going to conduct auction.
On the other hand, Smt. K.Lalitha, learned Standing counsel for the fourth respondent, submits that so far as the auction is concerned, there is no illegality, but, however, they would follow due process of law. Recording the said submission, the Writ Petition is disposed of directing the respondent-authorities not to evict the petitioner from the subject land without following due process of law. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand closed. _____________________ (A.RAJASHEKER REDDY, J)
