The present writ petition came to be filed seeking issuance of writ of Mandamus declaring the action of the fourth respondent in mutating the entries in pahanis in the name of third parties without issuing any notice in Survey Nos.227/ 3A/ 1, 227/ 3A/ 2, admeasuring Acs.2.72 cents in patta numbers 1408 and 1409, as illegal and arbitrary.

Though various grounds are raised, the only ground urged by the learned counsel for the petitioner is that the Tahsildar incorporated the names of the unofficial respondents by deleting the name of the petitioner without issuing any notice. The learned counsel for the respondents would submit that the matter may be sent back to the Tahsildar, directing him to pass appropriate orders after giving notice to both the parties at the earliest.

A perusal of the record discloses that the impugned proceedings came to be issued without giving notice to the petitioner. 5.

Having regard to the above, the writ petition is disposed of directing the fourth respondent to pass fresh orders with regard to mutation of the names in revenue records in respect of land in Survey Nos.227/ 3A/ 1, 227/ 3A/ 2, admeasuring Acs.2.72 cents situated in Thambiganipalli Village, Kuppam Mandal, in patta numbers 1408 and 1409, after hearing the petitioner and the respondents, in accordance with law, which in any event shall be done within a period of three months from the date of receipt of a copy of the order. Till such time, status quo as on today to be maintained. No costs.

Miscellaneous petitions, pending if any, shall stand closed in the light of this final order.
