THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.27746 OF 2018 ORDER :

Heard learned counsel for the petitioner, learned Government Pleader for Municipal Administration and Urban Development, Sri Sampath Prabhakar Reddy, learned Standing Counsel for GHMC, and Sri T.Venkata Ratnam, learned counsel, apart from perusing the entire material available on record. The sum and substance of the case of the petitioner, in the present Writ Petition, is that, he is the owner of the house situated adjacent to the house of the unofficial respondents and that, without any sanction, the unofficial respondents are making constructions and they are not leaving any set backs also.

A counter-affidavit is filed by the unofficial respondents stating that, after obtaining permission from the GHMC, vide permit No.3/C2/12403/2018, dated 26.07.2018, they are making constructions, strictly in accordance with the sanctioned plan, not as alleged by the petitioner herein. On the other hand, it is submitted by the learned Standing Counsel that, as alleged by the petitioner herein, if there are any deviations from the sanctioned plan, and, if there are no set

backs, as alleged by the petitioner herein, appropriate action will be taken, strictly as per law, after issuing notices. In view of the above, this Court deems it appropriate to dispose of the Writ Petition, with a direction to the third respondent to take appropriate action, if there are any deviations in the construction made by the unofficial respondents, after issuing notice to the petitioner herein.

Accordingly, Writ Petition is disposed of. There shall be no order as to costs.

As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed.
