THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.5970 of 2016 ORDER:
Heard learned counsel for the petitioner and learned Government Pleader for Revenue.
The petitioner seeks implementation of decree stated to have been granted in his favour in O.S.No.64 of 1996 on the file of the Junior Civil Judge, Achampet, as confirmed in A.S.No.2 of 2000 on the file of the Senior Civil Judge, Nagarkurnool. The petitioner made an application before the Tahsildar, Balamoor Mandal, and his name was recorded in the revenue records. However, alleging that the legal heirs of the defendant are interfering with his possession, he made an application before the 3rd respondent for police protection. The 2nd respondent vide letter dated 03.06.2015, Ex.P1, directed the 3rd respondent to go through the contents of the petition, conduct detailed enquiry and take appropriate action as per the Agency Area Rules. The petitioner's application dated 07.10.2015, Ex.P2, is stated to be still pending with the 3rd respondent and alleging that no action is taken, the present Writ petition is filed.
In the facts and circumstances of the case, it is appropriate that the 3rd respondent shall examine and take appropriate decision on the petitioner's application dated 07.10.2015, Ex.P2, in the light of the directions already issued by the 2nd respondent, dated 03.06.2015, Ex.P1, referred to above.
The Writ Petition is accordingly disposed of. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
