THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.3076 of 2016 ORDER:

The petitioner company earlier filed W.P.No.21221 of 2015 before this Court against the very same G.Os. which are subjected to challenge in this writ petition. The only change appears to be that the challenge is now sought to be supported by relying upon the U.O.Note dated 19.11.2015 issued by the Secretary to the Government, Industries and Commerce (M.II) Department, Government of Telangana.

Admittedly, W.P.No.21221 of 2015 is still pending consideration before this Court. In that view of the matter, it is not open to the petitioner company to file a fresh writ petition with the very same prayer only to supplement its challenge by referring to additional material. It would always be open to the petitioner company to take steps in accordance with law for including additional material in support of its challenge in the pending writ petition. Unnecessary multiplicity of proceedings on the same cause of action cannot be permitted. The writ petition is accordingly dismissed leaving it open to the petitioner company to take steps in the pending writ petition in accordance with law, if so advised.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
