HONOURABLE SRI J USTICE M.S.K . J AISWAL CRIMINAL PETITION No. 2220 of 2015 ORDER:

This Criminal Petition under Section 482 Cr.P.C. is filed to quash the proceedings in FIR No. 240 of 2015 on the file of Station House Officer, Police Station, Banjara Hills, Hyderabad, registered for the offences punishable under Sections 420, 506 IPC read with Section 156 (3) Cr.P.C.

During the course of arguments, it is submitted by the learned Counsel on either side that the police have completed the investigation in the aforesaid crime and thereafter filed charge sheet; however, the trial Court returned the charge sheet on certain objections.

In view of the aforesaid submission of the learned Counsel on either side, it is not necessary to go into the merits or otherwise of the subject matter at this stage.

Having regard to these facts and circumstances of the case, the police are directed to resubmit the charge sheet within ten days from the date of receipt of a copy of this order and on filing of the charge sheet by the police, the learned Magistrate shall proceed with the same in accordance with law and pass appropriate orders on merits.

Inasmuch as this Court has already directed the police not to arrest the petitioners till 15.09.2016, the same order shall

continue till the charge sheet is resubmitted and cognizance of the offences taken thereon.

The Criminal Petition is accordingly disposed of.

Miscellaneous petitions pending consideration if any in the Criminal Petition shall stand closed in consequence. No order as to costs.
