The Hon'ble Sri Justice Abhinand Kumar Shavili Civil Revision Petition Nos.3035 & 3059 of 2012 Date: 16.10.2017 Common Order:

These two Civil Revision Petitions are filed against two separate but similar Orders, dated 25.11.2011, in ATA.Nos.5 and 6 of 2010, on the file of the Tenancy Appellate Tribunal -cumPrincipal District Judge, West Godavari at Eluru. Heard both the learned Counsel for the parties and perused the record. Since the parties and the subject matter are same, both these Civil Revision Petitions are disposed of by a Common Order with the consent of the learned Counsel for the parties. At the hearing, it has been submitted by the learned Counsel for both parties that the petitioners/landlords have not preferred any appeal against the orders passed in ATC.Nos.4 and 5 of 2008; that during the pendency of these Civil Revision Petitions, they have filed ATC.Nos.

4 and 5 of 2012 before the Special Officer (Tenancy)- cum- Junior Civil Judge, Nidadavolu, West Godavari District, seeking eviction of the respondent and to decide the fair rent respectively, which are pending; that both the parties will abide by the outcome of ATC.Nos.4 and 5 of 2012 and that therefore, that no useful purpose would be served, if the issue in the present Civil Revision Petitions is adjudicated.

AKS, J CRP.Nos.3035 & Dt: 16.10.2017 In view of the above submissions of the learned Counsel for the parties, which are placed on record, these two Civil Revision Petitions are closed.

Consequently, Miscellaneous Petitions, pending if any, stand dismissed as infructuous.
