SMT. JUSTICE T. RAJANI CRIMINAL PETITION No.2242 of 2017 ORDER:
This petition is filed for quash of proceedings in C.C.No.84 of 2016 on the file of Additional Junior Civil Judge, Chilakaluripet, against the petitioner/A.4.
Heard learned counsel for the petitioner. Learned Public Prosecutor takes notice for the first and second respondents. Both of them agree for the matter to be disposed of at the admission stage.
Learned counsel for the petitioner submits that the petitioner is not working as General Manager at the place where the fire accident took place and that his name was erroneously included and that he reported to the Branch Office, Guntur, on 12.06.2013 and there are proceedings to that effect. At the stage of quash, the materials produced by the petitioner/accused cannot be looked into. Whether he worked as General Manager of the company, where the fire accident took place, or not is a matter of fact which has to be gone into at the time of trial. Hence, there are no grounds to quash the proceedings in C.C.No.84 of 2016.
TR, J Crl.P.No.2242 of 2017 Hence, the Criminal Petition is dismissed.
Pending miscellaneous petitions, if any, shall stand dismissed.
