THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN WRIT PETITION NO.22987 OF 2008 ORDER:

The petitioner's grievance in this Writ Petition is that the respondents were not taking any action against the sixth respondent on their representation; and their failure to do so was arbitrary and illegal.

The sixth respondent, who had already constructed a house in the 1990's, is said to have been surreptitiously sanctioned a house under the Indiramma Phase-I Housing Scheme several years thereafter. The petitioner alleges that respondent Nos.2 and 5 had, in collusion with local politicians, prepared bills for release of amounts to the said bogus house with the malafide intention to knock away public money.

By the interim order dated 22.10.2008, this Court directed respondent Nos.2 and 3 to consider the petitioner's representation dated 20.09.2008, and to pass appropriate orders after hearing the petitioner as well as the sixth respondent. Till such time, interim stay of disbursement of amount was granted.

Today Sri M.Ravindranath Reddy, learned Standing Counsel for the A.P. Housing Board, would submit that, since the very sanction of a house to the sixth respondent, has been found not to be in order, proceedings have already been initiated to cancel sanction of the house, under Indiramma Housing Scheme, to the sixth respondent; and cancellation orders would be passed shortly. In view of the submission of Sri M.Ravindranath Reddy, learned Standing Counsel, I consider it appropriate to dispose of the Writ Petition directing the respondents to pass orders of

cancellation, in accordance with the decision already taken by them with utmost expedition and, in any event, not later than one month from today. In the light of the interim orders passed by this Court earlier, directing stay of disbursement of amounts, the respondents shall not disburse any amount to the sixth respondent, under the Indiramma Housing Scheme, in view of their earlier decision not to do so.

The Writ Petition stands disposed of accordingly. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
