Petitioners claim that there are certain slots earmarked to scheduled caste category candidates in the Deputy Tahsildar Cadre available in the panel year 2006-07. But these slots were not filled up, thereby depriving the right of the petitioners for their promotion from an earlier date. Petitioners contend that in an order passed on 17.01.2014, it refers to inclusion of their names in the panel year 2011-12, whereas such inclusion ought to have been made in the earlier year panel. Ventilating their grievance, representation was submitted and the same is not acted upon. 3.

When the matter is taken up, learned counsel for the petitioners represent that petitioners would be satisfied for the present, if a direction is issued to consider the representation submitted by them on 26.11.2016.

Having regard to the said submission, this Court is not inclined to express any opinion, at this stage, on the above aspect. Since petitioners contend that their representation is not acted upon, this Court is not inclined to keep the writ petition pending. 5.

Accordingly, the Writ Petition is disposed of with the following order :

The Chief Secretary to Government, Revenue Department, is directed that if the representation of the petitioners dated 26.11.2016, is received, he shall examine the claim made by them, vis-à-vis permissibility of such a claim made with reference to

limitation prescribed for review of panel in the Andhra Pradesh State and Subordinate Service Rules, 1996 and if the authority is in favour of accepting the prima-facie claim of the petitioners with reference to inclusion of their names in the panel for promotion earlier to the panel in which actually their names have been included, put on notice all those persons who are likely to be effected and take appropriate decision after considering their grievance.

It is needless to observe that the Court has not expressed any opinion on the maintainability of such a claim and such consideration, if any, shall be subject to maintainability, having regard to the limitation prescribed in the Andhra Pradesh State and Subordinate Service Rules. A decision to this effect shall be communicated to the petitioners within a period of two (2) months from the date of receipt of copy of this order. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
