THE HON'BLE SRI JUSTICE SURESH KUMAR KAIT AND THE HON'BLE SRI JUSTICE D.V.S.S.SOMAYAJULU ASMP No.2391 of 2017 And/in APPEAL SUIT No.736 OF 2011 ORDER: (Oral ) (Per Hon'ble Sri Justice SURESH KUMAR KAIT) ASMP No.2391 of 2017 has been filed by the petitioner/appellant to dispose of the A.S No.736 of 2011 by recording the terms of compromise as agreed among the parties herein in terms thereof.
2. Learned counsel appearing on behalf of the petitioner/appellant, on instructions from the appellant, who is present in Court, seeks permission to withdraw the instant petition, as the matter has been compromised out of the Court between the appellant and the respondent.
3. On identification of appellant-Jangeti Parthasarathi, photocopy of Aadhar Card vide No.3390 6923 0815 is produced, attested by the learned counsel appearing on behalf of the appellant, and the same is taken on record.
4. On identification of respondents, the respondent No.1-B.Dayasagar, has produced original Aadhar card vide No.9820 6219 4807. Photocopy of the same is taken on record. Original seen and returned to the respondent No.1. The respondent No.2-Jangeti Goverdhan is concerned, he has produced original Driving Licence vide No.
TS01020170005984. Photocopy of the same is taken on record. Original seen and returned to respondent No.2. 5.
The matter has been compromised vide Memorandum of Compromise filed under Order XXIII Rule 3 of CPC, which is at page No.3 of instant petition.
6. In view of compromise, ASMP No.2391 of 2017 is allowed. Consequently, A.S.No.736 of 2011 is disposed of in terms of compromise mentioned above.
Miscellaneous petitions, if any, pending shall stand closed.
