THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.14801 of 2015 ORDER:

Petitioner was working as a permanent fair price shop dealer. Vide proceedings, dated 31.03.2015 issued by the third respondent - Revenue Divisional Officer, Tekkali, the petitioner's fair price shop authorization was cancelled and a case under Section 6-A of the Essential Commodities Act was booked for the irregularities noticed. Aggrieved by the said order, the petitioner has preferred an appeal before the second respondent - Joint Collector, Srikakulam. The petitioner has stated to have filed an application for interim stay along with the appeal by contending that her fair price shop authorization is valid up to 31.03.2016 and there is no adverse remark against her. Alleging inaction on the part of the second respondent in taking up the said appeal and/or stay application, she has filed the present Writ Petition.

Since the validity or correctness of the proceedings, dated 31.03.2015 issued by the third respondent is pending adjudication in appeal before the second respondent, it is not appropriate to make any observation with regard to the petitioner's contention against the said proceedings. However, since the petitioner's appeal along with the stay application is pending before the second respondent, I deem it appropriate to direct the second respondent to fix a date of hearing, hear the petitioner's appeal and/or the stay application filed therein and pass appropriate orders preferably within four weeks from today. With the above directions, the Writ Petition is disposed of. No order as to costs.

Miscellaneous Petitions, if any pending in this Writ Petition shall stand closed.
